DIGITAL EVIDENCE STRATEGY · SECONDARY SPECIALIST PRACTICE

Digital evidence review and technical second opinion

When a dispute or business decision depends on digital material, understanding what that material can actually establish becomes essential to the assessment. The practice supports counsel and businesses in critically reviewing technical reports and records, drawing on Federica Bertoni's experience of more than twenty years in digital forensics and evidence reconstruction.

A review focused on the question

An engagement may examine an existing court-appointed expert report, a party expert report, a forensic assessment, a record of examination, or a report generated by a forensic tool. It is relevant when the client needs to understand the method applied, identify unresolved issues, or formulate further questions for the specialists conducting the examination.

This is a secondary specialist practice alongside the Studio's main work in cyber geopolitics, Strategic Cyber Threat Intelligence, and AI Risk. Each request is assessed against the available records and the expertise the question requires.

What is examined

The review considers the provenance, integrity, completeness, and timing of digital evidence, examining whether the reasoning from data to conclusions can be reconstructed. It also addresses competing explanations, implicit assumptions, and limitations in the available material, placing the significance of each finding in the context of the question being asked.

Missing documentation and further examinations are identified explicitly. The assessment distinguishes issues that can be evaluated from the records from those requiring additional technical work by the professional responsible for examining the relevant systems or media.

Technical questions and an evidence plan

Depending on the agreed scope, deliverables may include a methodological review note, verifiable technical questions, and a plan identifying evidence to preserve or obtain. The plan sets out relevant sources, missing materials, and priorities, explaining which examination is needed at each stage and which conclusions remain open. This gives counsel or the corporate contact a documented basis for directing the technical discussion and considering the next steps.

An illustrative review question

In an illustrative case, a report might attribute an action to a person on the basis of a file's presence or the use of an account. The review examines the reasoning supporting that attribution, the circumstances that still need to be reconstructed, and whether alternative explanations remain to be tested. The existence of an artifact and the identification of the person responsible for an action are treated as distinct propositions.

Introducing the matter

For an initial inquiry, provide the type of matter, the general question, the deadline, and the categories of records available. Confidential documents should be shared only after the engagement's scope and sharing arrangements have been agreed. The work focuses on analysis and methodological supervision of the material within that defined remit.
